Small Claims Act in effect as of January 1, 2013

Starting on January 1, 2013, the New Brunswick Small Claims Court will commence accepting claims.   Matters will be heard in the Small Claims Court for actions for debt, damages and/or the return of possession of personal property for an amount up to $12,500.  Claims will be heard by an adjudicator and the process will be somewhat less formal than regular court processes.

The Small Claims Court procedure is governed by the Small Claims Act and the General Regulation under the Act.  There are a specific set of forms that must be used in the Small Claims Court.

For an action started in the Court of Queen’s Bench under Rule 80, prior to January 1, 2013, all parties will complete their proceedings in the Court of Queen’s Bench under the Rule 80 process.
