What are the costs for filing claims under the Small Claims Act?

The New Brunswick Small Claims Act came into force in 2012. Section 71(1) of Regulation 2012-103 under the Small Claims Act lists the fees payable.

For filing a claim or a response with a counterclaim:

  • if the total of the claim or the counterclaim is $3,000 or less, the fee is $50.
  • if the total of the claim or the counterclaim exceeds $3,000, the fee is $100.

For filing a response denying all or part of a claim, with no counterclaim, the fee is $25.

For filing a third-party claim, the fee is $50.

For filing a third-party response denying all or part of a third-party claim, the fee is $25.

For a photocopy of a document, the fee is $0.50 per page.

For a certified copy of a document, the fee is $10.

For a search, the fee is $10.

Fees can be paid by cash or card when you file your claim in person. Certified cheques and money orders can be made payable to the Minister of Finance. Fees CANNOT be paid by personal cheque.
